What is Joe Biden’s authority to create a CBDC?

Subject: Creation of a Central Bank Digital Currency by the Biden Administration

Thank you for your written reply to my message on this same subject.

The first three articles of the U.S. Constitution prescribe the powers and duties of the three branches of government. Superseding the powers of the three branches is God with plenary powers and We the People with inherent powers. Contrary to the popular myth perpetuated by public educational institutions, the Legislative Branch, the Executive Branch, and the Judicial Branch do not have equal powers.

1. The Legislature crafts laws and appropriates taxes to pay for government operations.
2. The Executive Branch executes the Supreme Law of the Land, as per Article VI, Clause 2.
3. The Judiciary does not create laws and does not decide the constitutionality of laws. The Judiciary largely resolves disputes arising on points of law. I quote: “The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—to all Cases affecting Ambassadors, other public Ministers and Consuls;—to all Cases of admiralty and maritime Jurisdiction;—to Controversies to which the United States shall be a Party;—to Controversies between two or more States;— between a State and Citizens of another State,—between Citizens of different States,—between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.”
4. The Constitution, under Article VI, Clause 2, decides the constitutionality of laws and treaties.

I searched Article II of the U.S. Constitution for any Executive Branch power to create money, or currency, or to change our monetary system in any manner whatsoever. Such power was not assigned to the Executive Branch.

However, I do find this in Article I, Section 8, the Enumerated Powers of Congress.

(Clause 1) The Congress shall have Power … (Clause 5) To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures; and (Clause 6) To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;

President Biden’s Executive Order on Ensuring Responsible Development of Digital Assets is unconstitutional. This power is reserved to the Legislative Branch, Congressman Fallon. You have this power.

I ask you to bring this matter before the House of Representatives. Naturally, Joe Biden will dispute your Article II enumerated powers. The U.S. Supreme Court will find the President at fault because you and your fellow lawmakers have this power.

The rise of Marxism and communism in our country, encountering little opposition from poorly educated lawmakers and attorneys, has progressed and has taken seats in our Congress. I do not hesitate to declare the obvious: Bernie Sanders, an avowed socialist holding an important committee chair in the Senate; Alexandria Ocasio-Cortez, the Democrat representative from New York, a young woman recruited by the Democratic Socialists of America, the largest communist organization in the entire country, to run for a seat in the House, along with others.

Your most powerful friend and tool is the Constitution. Please quote it; please share your knowledge with all members of the House of Representatives. Continue to oppose a CBDC for the sake of our children and grandchildren.
