Sharia Law in the United States is Unconstitutional

The Supreme Law of the Land

Article IV, Section 4 of the U.S. Constitution stipulates:

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

What Is a Republic?

The English word republic derives from the Latin phrase rēs pūblica, ‘the people’s thing’.

What, then, is a republic? A republican government is one in which the people—directly or indirectly—are the ultimate source of authority, electing representatives to make laws that serve their interests and advance the common good. A constitutional republic, however, also limits the power of the majority through a framework that promotes competent government and affords protection for fundamental rights. Biblical Bases of the Republican Form of Government

From Isaiah 33:22, we have three branches of government:

  • Legislative (the Lord is our lawgiver)
  • Executive (the Lord is our king)
  • and judicial (the Lord is our judge)

The concept and model for representation of the people has its model in Exodus 18:17-26. Representation applies to both lawmaking and judicial resources.

Is Any Other Form of Government Constitutional?

Sharia is both a government and a pagan religion; a religion, nevertheless. The ‘constitution’ of Saudi Arabia is the Quran, and the only ‘bible’ is the Quran. Islam is a theocracy.

Article VI, the second clause, stipulates:

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

Summary

  • The federal government features three branches: legislative, executive, and judicial.
  • Each state features three branches of government: legislative (state legislatures), executive (a governor), and a judiciary (state courts of law)
  • All cities feature three branches of government: legislative (city councils), executive (city manager), and judiciary (municipal courts)

Application

Applying a form of law outside the constitutionally prescribed republican form of government has no legal authority for any community. It is classified as treason and is punishable by law. Reference: 18 USC Ch. 115: TREASON, SEDITION, AND SUBVERSIVE ACTIVITIES

A bill introduced in the House of Representatives was crafted to outlaw Sharia Law. Such an Act of Congress is unnecessary. Implementing any form of law contrary to the Supreme Law of the Land is a criminal offense.
