Report from Texas Gun Rights, June 18, 2024, Surgeon General Declares Gun Violence a Public Health Crisis

The 2nd Amendment limits ALL governments, federal, state, county, and municipal. The key text in this Amendment: “the right of the people to keep and bear Arms, shall not be infringed.

Where in the U.S. Constitution do we find federal authority over our health? The words medicine, medical, sickness, disease, and like terms related to one’s health appear nowhere in the Constitution.

Keep in mind the definition of the supreme Law of the Land: “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land.”

The U.S. Department of Health & Human Services website points to federal laws and regulations cataloged in the CFR. Are Acts of Congress that are not authorized by the U.S. Constitution lawful? Are the laws and regulations of the Health Department “in pursuance of the Constitution?” The answer is, no.

Only the States and the People have authority over human health.

As a refresher, the text of the 10th Amendment says, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Only the Texas Department of Health and Human Services and the Texas Legislature have authority over health and medical issues in our state.

Now you can understand why the U.S. Supreme Court reversed the 1973 Roe v. Wade decision.
