Subject: S. 292, the Educational Choice for Children Act (ECCA)
I truly and greatly appreciate all you do to make America great again, Mr. President.
I realize you depend on your expert staff and department heads. They confirm legal actions and the constitutionality of your ambitious undertaking. This undertaking aims to cut waste, fraud, and abuse of federal funds.
I bring to your attention a bill in the House of Representatives at this time, S. 292, the Educational Choice for Children Act (ECCA).
I point to the constitutionality of the bill.
Article VI, the second clause, defines the Supreme Law of the Land. “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land…“
S. 292, the Educational Choice for Children Act (ECCA), is not ‘in pursuance of’ the Constitution.
I refer you and your staff to Article I, Section 8 of the Constitution. This section enumerates the limited powers of the Federal Government.
A word search of the text of this section does not include education, public, or private. In fact, the word ‘education’ is not to be found in any of the articles of the Constitution.
The bill will increase federal spending and require costly manpower for its execution and implementation.
Have I contacted my Representative, Pat Fallon (TX CD-4)? Yes. I urged him to OPPOSE the bill. His automated response thanked me for SUPPORTING the bill.
I urge you to not sign the bill if it comes to your desk.
